the use or possession of the data or the NAVTEQ Data. The licensors shall
not be liable in any way for loss of revenues or contracts, or any other
consequential loss of any kind resulting from any defect in the data or the
NAVTEQ Data. End User shall indemnify and save harmless the licensors and
their officers, employees and agents from and against any claim, demand or
action, irrespective of the nature of the cause of the claim, demand or action,
alleging loss, costs, expenses, damages or injuries (including injuries
resulting in death) arising out of the use or possession of the data or the
NAVTEQ Data.
15. APPLICABLE LAW. This EULA is governed by the laws of the Netherlands
without giving effect to (i) its conflict of laws provisions, or (ii) the United
Nations Convention for Contracts for the International Sale of Goods, which
is explicitly excluded. You agree to submit to the jurisdiction of The
Netherlands for any and all disputes, claims and actions arising from or in
connection with the Data provided to you hereunder.
16. ENTIRE AGREEMENT. This EULA (including any addendum or amendment
to this EULA which is included with the Product) is the entire agreement
between you and Dell relating to the Software Product and it supersedes all
prior or contemporaneous oral or written communications, proposals and
representations with respect to the Software Product or any other subject
matter covered by this EULA. To the extent the terms of any Dell policies or
programs for support services conflict with the terms of this EULA, the terms
of this EULA shall control.
